These Terms and Conditions (“Terms”) govern the use of the augmenos.com website and all mobile and spatial computing applications published by Augmenos (collectively, the “Services”). Use of the Services is also subject to the Privacy Policy.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1. Eligibility

The Services are intended for users aged sixteen (16) or older. Users under eighteen (18) must have parental or guardian consent. By using the Services, you confirm that you have the legal capacity to enter into a binding agreement.

2. Acceptable Use

You agree not to use the Services in any way that:

• Violates applicable laws or regulations;
• Infringes upon the rights of others;
• Is fraudulent, deceptive, harmful, threatening, harassing, defamatory, obscene, or otherwise objectionable.

3. Health and Safety

Certain applications provide immersive experiences. Use the applications in a safe, clear area, remain aware of your surroundings, and follow the health and safety guidelines of your device manufacturer.

4. Purchases and Third-Party Platforms

Applications are distributed through the Apple App Store, Google Play Store, or other platforms. Purchases, payments, and refunds are processed by the applicable platform and are subject to its terms and policies. The terms of the applicable platform also apply to the use of the applications.

5. Intellectual Property

All content, features, and functionality of the Services are the exclusive property of Augmenos and its licensors, unless otherwise stated or in the public domain. Augmenos trademarks and trade dress may not be used without prior written consent.

6. Links to Third Parties

The Services may contain links to third-party websites or services. Augmenos does not control and is not responsible for the content, privacy policies, or practices of such third parties.

7. Termination

Augmenos may suspend or terminate access to the Services at any time, without prior notice, for conduct that Augmenos determines violates these Terms or is otherwise harmful to the Services.

8. Disclaimer

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied. Use of the Services is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Augmenos and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Services.

10. Indemnification

You agree to indemnify and hold harmless Augmenos, its affiliates, and their respective officers, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your use of the Services or breach of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws provisions. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Arnhem, the Netherlands. Nothing in these Terms affects the mandatory consumer protections afforded by the laws of your country of residence.

12. Changes to These Terms

Augmenos may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Services after such updates constitutes acceptance of the revised Terms.
